Mandatory diagnostics for the sale

The mandatory diagnostics

Are you selling your property? You must provide the buyer with a technical diagnosis file whose content depends on the type of property you are selling, its location, its equipment and its construction date.

Asbestos:
This diagnosis is mandatory for all buildings whose building permit was issued before July 1, 1997.

Lead:
This diagnosis is mandatory for all residential properties built before January 1, 1949.

Termites:
This diagnosis is mandatory for all buildings located in a contaminated area determined by a prefectural order.

The internal gas installation:
This diagnosis is mandatory for all properties with an internal gas installation older than 15 years.

The internal installation of electricity:
This diagnosis is mandatory for all properties for residential use with a gas orelectricity installation over 15 years old.

The diagnosis of energy performance:
This diagnosis is mandatory for all closed and covered buildings with a heating system.

The state of risks and pollution:
This diagnosis is mandatory for all properties, including land, when they are located within the perimeter of a risk prevention plan, or seismicity.
Since January 1, 2018, it also includes information on soil pollution. As of January 1, 2023, the content, methods for drawing up and submitting the state of risks are changing (see sheet no. 10-6).

The state of thenon-collective sanitationinstallation:
This diagnosis is mandatory for all properties for residential use that are not connected to thecollective sanitation network.

The merula:
The information is mandatory for all buildings located in a contaminated area determined by a prefectural order.

Information on the risks of airborne noise pollution:
This document is mandatory for housing located in a zone of exposure to noise from airfields.

The certificate attesting to the compliance of the wood-burning appliance with the installation and emission rules.

This document is only required if the property is within the perimeter of an atmosphere protection plan. These installation and emissions rules have been set by the prefect of the department.

Alongside the technical diagnostic file, other documents must be provided, including:

The energy audit:
It is mandatory for residential properties, individual or single-ownership, classified F or G and subject to a promise of sale or, in the absence of a promise of sale, a deed of sale on April 1, 2023. The sale of property in joint ownership is excluded from this obligation. This obligation is extended to dwellings classified E on January 1, 2025 and to dwellings classified D on January 1, 2034. This audit lists and precisely details two work scenarios to improve the energy performance of the dwelling to reach at least class E and at best class C in one go or in several steps. This energy audit is valid for 5 years and must be given to the candidate buyer(s) on the first visit to the property, in addition to being attached to the promise of sale.

The housing information book:
It is mandatory from 1 January 2023. It makes it possible to facilitate and support the performance of work to improve the energy performance of residential accommodation and its annexes, but also the installation of control equipment and active management of the 'energy. It informs about the work carried out. It must be established during the construction of the accommodation (concerns applications for building permits or prior declarations made from January 1, 2023) or during renovation work starting or for which the estimate has been accepted from January 1, 2023 , on an existing asset and which have an impact on the energy performance of the asset. It must then be updated, if necessary. This housing information book must be sent to the purchaser, at the latest, on the day of the signing of the authentic deed.
